Annual HOA dues could rise for all LOT OWNERS if we cannot form a Fining Committee to control legal fees.

Cumberland Manors needs volunteers to meet just one time every three months.

A Fining Committee, governed by changes in state law, could mean savings of THOUSANDS of DOLLARS in legal fees EVERY YEAR.

Right now, to enforce our covenants, we mail a couple of warning letters. If that fails, we begin to pay the HOA’s attorney to take legal action to correct violations.

Instead, if we have a fining committee, the HOA Board of Directors could vote – if the two violations letters are rebuffed - to refer violations to the Fining Committee. This would be a cost-saving alternative to paying attorney’s fees to enforce covenants.

The Fining Committee can issue fines of up to $100 a day up to $1,000 for continuing fines of EACH violation. Property owners who dispute violations could speak at the quarterly Fining Committee meetings. They also would be notified of an upcoming Fining Committee meeting and fix the violation prior to the meeting to avoid a fine.

It would be a Win-Win for everyone; the HOA can enforce covenants without paying attorney’s fees and property owners – including owners of rental properties – would be more likely to fix violations to avoid fines.

Without a Fining Committee, the strain of our annual legal expenses could force the Cumberland Manors HOA to increase annual dues beyond the normal rise in operating expenses.

We need to maintain our community’s standards to preserve our neighborhood’s quality of life AND our property values. A Fining Committee could be vital in protecting our quality of life.
